• Definitions: For the purposes of these terms and conditions the following definitions are as follows:
• Application: means mobile application “Finsight” and all its versions or variants.
• Application User: means any person or entity who registers himself on the Application and can be an individual, Corporation, Partnership Firm or any other legal entity.
• Account: means unique account created by the Application User to use our service.
• Content: means any text, image, comment or any other information that can be posted or uploaded or otherwise made available to or by the Application User during the use of our service regardless of the nature of that content.
• Device: refers to the device such as Mobile or any other device on which the Application can be installed and run
• Feedback: refers to any suggestions, feedback or innovations given by You regarding the improvement and performance of the Application
• LLP: refers to the Codexa Finsight Services LLP (hereinafter referred as Codexa/us/our/we for the sake of brevity)
• Person: includes an individual, Company, LLP, Partnership, corporation or any entity registered under any Act.
• Service: means data, graphs, analysis, summary or any other information of the stocks, bank F.D.s or any other financial instrument provided by us on our application platform.
Interpretation:
• Any gender includes all genders wherever necessary.
• Singular includes plural and vice-a-versa as required in the given context.
By accessing our Application, you agree to accept the Terms and Conditions set out herein.
• The Application User must be at least 17 years of age to access and use the Application. Anyone below 17 years of age shall not use the Application.
• Your access to and use of the Service is also conditioned on Your acceptance of and compliance with our Privacy Polices. Our privacy policy describes our policy and procedure of collecting Your data and how we process, store and use it in our Application. Please read the Privacy Policy given below:
• When You create a User Account with us, please provide Your information that is accurate, current and complete in all respect.
• You shall always keep your password confidential. If you become aware of any breach of security or any unauthorized use of Your account, please NOTIFY/INFORM us immediately (at support@finsightsocial.com).
• You shall not use any username that is unlawful, vulgar or derogatory in nature. You shall also not use any name or trademark that is subject to the rights of any other person or entity without appropriate authorization from the concerned person or entity. You must not impersonate others or create account for someone else without their express consent.
• You must not create accounts or collect information and data from our service in an automated way. If such multiple, fraudulent and fake accounts or activities are found by us Your access and use to our service will be terminated without any notice or intimation to You.
• You must not use or post any confidential information of third party without his express consent. You covenant and represent to us that You own and/or have obtained all necessary permissions in respect of any content that is posted by You while using our service.
• Our service allows You to post content related to shares, finances and stock market. You expressly understand and accept that You will be responsible for any content or any other activity that happens under Your account whether that is done by You or any third party using Your account. We expect that any content posted by you will be legal, reliable and appropriate. We shall not be held liable and responsible for any content that is posted by You or any third party using Your account.
• Our service only provides an analysis of the data that is collected or received from the official Stock Market Data Provider for any Stock Exchange. You expressly understand and accept that any information provided on our Application is for informational purposes only and is not to be interpreted or taken as a financial advice or promotion of any shares or product or any company/entity.
• You expressly understand and accept that any financial advice given by any user on our Platform will be solely the responsibility of such user and we shall not be responsible for any advice given or opinion expressed by any user on our Platform.
• We shall not be held responsible and liable and do not vouch for the accuracy of any content or any information that is posted or provided by any User on our Platform.
• It will be our sole discretion and right to take down any objectionable content that is posted by an Application User including but not limited to the content that:
• Is unlawful, offensive, hateful, vulgar or derogatory in nature.
• Is unlawful or promotes unlawful activity.
• Is Defamatory or Discriminatory including references and comments about race, religion, ethnicity, sexual orientation, gender, nationality or targeted groups.
• Is Unauthorized or in the nature of Unsolicited advertising or spam or unauthorized or unsolicited gambling or lottery.
• disrupts, damages or limits the functioning of our service or tries an unauthorized access for information and data of a third person.
• installs or transmits viruses, worms, malware and trojan horses.
• infringes the privacy of a third person.
• Impersonates any person, company/entity or its employees and representatives.
• is false or misleading.
• Infringes intellectual proprietary rights of third person which includes trademark, trade secret, copyright and other right.
• We reserve the right but not an obligation to determine in our sole discretion whether the content posted by the Application Users is in accordance and compliance with our Terms and Conditions of service. We can also limit or revoke the service on account of any objectionable content posted by You or any third person using Your account.
• Although measures have been taken by us to delete objectionable content, we cannot control each and every content that is posted on our platform by our Application Users or third parties posting on behalf of such Users. You understand and accept that You may be exposed to content that is objectionable, false or indecent.
• You agree that under no circumstances will the Codexa be held liable and responsible for any error or technical glitch resulting in an malfunctioning or non-functioning of our services.
• By posting Content on our Application, You grant us the right and license to use, sub-license, modify, reproduce, create derivative works, publicly display, publicly perform or distribute such content on and through our service whether locally or worldwide. You are the owner and retain the rights of all and every content that is posted by You on our platform. You are responsible for protecting those rights.
• You represent and warrant that any content posted by You is exclusively Yours and You grant us the license to do any or all of the acts given in our Terms and Conditions and posting of any content that is Yours does not violate the proprietary and privacy right of any third person and/or company/entity. This license will end after deletion of Your account from our system. You can delete any post/s or content published by You on our platform.
• We may delete Your account if You are found to be repeatedly infringing other Users intellectual proprietary rights or for other legal reasons.
• We will be consistently updating the information available on our platform. We cannot and do not guarantee a complete accuracy in terms of the analysis provided in respect of the stock market data and/or other products. You understand and accept that we shall not be held legally responsible and liable for any loss or damage of any kind incurred by You by using or relying on our analysis of the stock market or of any particular stock for Your investment or any other purpose.
• Our service based on analysis of shares does not provide any financial advice. You agree that any reliance on our analysis of stock market will be entirely at Your own risk as to the consequences.
• We have used advanced technology such as Generative Artificial Intelligence, Machine Learning models to provide concise summary and analytics of stocks.
Privacy Policy:
• We collect Your data such as email address, name, date of Birth, username, password to create user account for using our service. Your information is stored and retained by us till the time You maintain Your account with us. Deleting your account will permanently erase all your data, including your profile, content, and settings. This action is immediate and cannot be undone. Some residual data such as comments or likes made by others on your posts may remain temporarily in our system and will be purged as part of our cleanup process. If you encounter any issues while deleting your account, please contact us at support@finsightsocial.com and we'll assist you in completing the deletion.
• We have taken appropriate measures to protect your data such as encrypting your passwords while creating user accounts. No direct access is given to the content posted by other Application Users except when You are following that User or if the user has kept his profile public and has created an account with us. We also do not sell your information to any third party.
• We may access, preserve and share your information in case of legal requests such as search warrant, court orders, summons and/or requests from civil litigants and/or other government authorities.
• You will be notified when there is any change in our Privacy Policy and You will be given an opportunity to accept/opt out of our revised Privacy Policy before continuing to use our service.
• Our service and its original content (excluding the content posted by You or other Users), the features provided by us and all functionalities of the Application are and will be exclusive property of us and our licensors.
• You will not use our trademark in connection with any other product or service without our express written consent.
• We have tried our best to provide a seamless service to you on “AS IS” and “AS AVAILABLE” basis. However, we do not guarantee that the service will always be secure, seamless, error free and without any disruption. We disclaim all warranties whether express or implied, statutory or otherwise with respect to our service and the information, analysis or contents, comments posted on our Platform.
• Without limitation to the foregoing, we do not warranty or undertake and make no representation of any kind that our service will achieve any intended result, meet Your requirements, be compatible or work with any other software, service, application, systems or system, perform and operate without any interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.
Without limiting the foregoing, we do not make any representation nor make warranty of any kind whether express or implied:
• as to the operation or availability of service or the information, content and materials included thereon.
• About our service being error free and without any disruptions.
• About the accuracy, reliability or currency of the information based on our analysis provided on our Platform.
• The laws of our country i.e., India shall govern the Terms and Conditions and Your use of this service.
• Any dispute, difference, controversy or claim (hereinafter collectively referred as Dispute) arising out of the use of our service shall be settled primarily by mutual negotiations and agreement. If for any reason such dispute cannot be resolved amicably then the same shall be referred and settled by way of arbitration. The arbitration proceedings shall be held in accordance with the Arbitration and Conciliation Act, 1996. The venue of the Arbitration Proceedings shall be Mumbai.
• If any provisions of this Application are invalid and unenforceable, such provisions will be changed and interpreted to achieve the objectives of such provision applicable under law and remaining provisions will continue in full force and effect. Failure to enforce any Term and Condition shall not be considered a waiver.
• We may use Your feedback or suggestions to improve our services. We are under no obligation to keep Your feedback and suggestions confidential or compensate you for the same.
• We reserve the right to amend, modify and/or replace these Terms and Conditions at our sole discretion. In case of any change or amendment to the present Terms and Conditions or our Privacy Policy, you will be given an option to accept/opt-out of revised Terms and Conditions. If you accept the revised Terms and Conditions, you will be bound by those.
